MEDICAL SCALES
To assess the extent of an injury, doctors use different severity scales, which in medico-legal terms, ranks the severity of the injury. Once this is done, the next step is to look at the compensation tables, officially drawn up by a small number of commissions and unofficially by certain courts, to determine the level of award to the victim (see “compensation of the injury” hereafter). The most well-known medical severity scale is available is “Concours médical”. By virtue of a decree implemented in 2003, this scale is applicable when an award is made by ONIAM for a medical accident or an infection acquired in a hospital or clinic. The decree (which incorporates the scale) can be obtained here. Another scale is that established by the Legal and Criminal Medical Society of France. |
